Intoxication Assault

A person commits intoxication assault if the person is driving while intoxicated, and causes serious bodily injury to another, whether by accident or mistake, because of the intoxication. This charge is typically punished as a third degree felony.

Intoxication Manslaughter

A person commits an offense if the person is driving while intoxicated, and causes the death of another, whether by accident or mistake, because of the intoxication.  This charge is typically punished as a second degree felony.
