You may be able to expunge your records if:

• You successfully completed a Pre-Trial Diversion or Intervention Program.  These programs are available in New Braunfels (Comal), Seguin (Guadalupe), San Marcos, Kyle, Buda (Hays), and Lockhart, Luling (Caldwell) for certain first-time criminal offenses.  

• Your case is dismissed, and the Statute of Limitations has passed.

• Your case is dismissed, and the District Attorney certifies that the records are not needed for any prosecution purpose.

• Your case was never officially filed or indicted, and you have satisfied the applicable waiting period.

• Your case was reduced to a Class C offense, and you completed a deferred adjudication probation.
